Privacy Policy

1. Who We Are
Silkflow Studio (“Silkflow,” “we,” “us,” “our”) is a creative + digital marketing studio based in Freeport, Grand Bahama, The Commonwealth of The Bahamas. We are the “data controller” in respect of personal information collected through silkflowstudio.com (the “Site”) and through our client engagements.
2. Legal Framework
This Policy is issued in accordance with the Data Protection (Privacy of Personal Information) Act, 2003 of The Bahamas (the “DPA”) and the principles administered by the Office of the Data Protection Commissioner. It also reflects our obligations under the Electronic Communications and Transactions Act, 2003. Where we serve clients or visitors based outside The Bahamas, we additionally apply, where applicable, principles drawn from the EU General Data Protection Regulation (GDPR) and similar frameworks.
3. Information We Collect
We may collect and process the following categories of personal information:
- Identity & Contact data — name, business name, email, phone, address, role.
- Project data — briefs, brand assets, content, login details you share with us to deliver Services.
- Financial data — billing details, invoice history (we do not store full payment-card numbers).
- Technical data — IP address, browser type, device, operating system, referring URL, pages viewed, and session timestamps.
- Marketing data — preferences and engagement with our newsletter or social channels.
- Communications — emails, contact form submissions, scheduling enquiries.
We do not knowingly collect “sensitive personal data” (as defined under the DPA). Please do not submit such data to us unless strictly necessary for an engagement.
4. How & Why We Use It
We process personal information to:
- provide, manage, and improve our Services and Site;
- respond to enquiries and prepare proposals;
- issue invoices and administer payments;
- comply with our legal, regulatory, tax, and anti-money-laundering obligations under Bahamian law;
- send newsletters or service updates where you have consented;
- secure our systems and prevent fraud or abuse.
Our lawful bases for processing under the DPA are: your consent; the performance of a contract with you; compliance with a legal obligation; and our legitimate interests in operating a sustainable business, balanced against your rights.
5. Cookies & Analytics
The Site uses a small number of cookies and similar technologies to operate essential features and to understand aggregate traffic patterns. You may disable non-essential cookies in your browser settings. We do not sell information collected via cookies. Where required, we will request your consent before placing non-essential cookies.
6. Sharing & Disclosure
We do not sell or rent personal information. We may share it only with:
- trusted service providers who process data on our behalf (e.g. hosting, email, analytics, payment processors), under confidentiality and data-protection obligations;
- professional advisers (accountants, lawyers) where reasonably required;
- governmental, regulatory, or law-enforcement authorities where required by law, including under the DPA, the Proceeds of Crime Act, 2018, or a valid court order issued in The Bahamas;
- a successor entity in the event of a merger, acquisition, or restructuring.
7. International Transfers
Some of our processors are based outside The Bahamas (for example in the United States, Canada, the United Kingdom, or the European Union). Where personal data is transferred outside The Bahamas we take reasonable steps, in line with section 17 of the DPA, to ensure that an adequate level of protection applies, including contractual safeguards with the recipient.
8. Retention
We retain personal information only for as long as is necessary for the purposes for which it was collected, including to satisfy any legal, accounting, or reporting requirements. Project files are typically retained for a minimum of seven (7) years following completion to comply with Bahamian record-keeping rules, after which they are securely deleted or anonymised.
9. Your Rights
Subject to the conditions and exemptions set out in the DPA, you have the right to:
- request access to the personal information we hold about you;
- request correction of inaccurate or incomplete data;
- request erasure where the data is no longer necessary;
- object to or restrict certain processing, including direct marketing;
- withdraw consent at any time where processing is based on consent;
- lodge a complaint with the Office of the Data Protection Commissioner of The Bahamas.

10. Security
We apply appropriate technical and organisational measures to protect personal information against unauthorised access, loss, alteration, or disclosure, including encrypted transit (HTTPS), access controls, and vetted vendors. No system is completely secure; in the event of a personal data breach affecting your rights, we will notify you and the Data Protection Commissioner where required.
11. Children
Our Services are not directed to individuals under eighteen (18). We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us so we can delete it.
12. Marketing & Unsubscribing
Where you have opted in, we may send occasional newsletters or service updates. You can unsubscribe at any time by clicking the link in any marketing email or emailing us. Unsubscribing will not affect transactional communications relating to an active engagement.
13. Third-Party Links
The Site may contain links to third-party websites. We are not responsible for the privacy practices or content of those sites and recommend you review their privacy notices.
14. Changes to This Policy
We may update this Policy from time to time to reflect changes in our practices or in Bahamian law. The current version will always be posted on this page with the “last updated” date.
